Restraining orders are protective orders issued by the court to prevent an individual from coming into contact with another person who feels threatened. If you have been threatened or feel unsafe around somebody, you can ask the court for a restraining order to protect you – but what happens when you move to another state or the person you are restraining moves to another state? Are restraining orders issued in another state valid in California?
Are Restraining Orders From Other States Valid in California?
In general, restraining orders issued in one state are valid in another state, according to the Violence Against Women Act (VAWA)
In California, out-of-state restraining orders are recognized and enforceable. You are NOT required to register out-of-state restraining orders with the superior court in California, although you can choose to do so. Here’s what you need to know about the process
- Fill out and take an Order to Register Out-of-State or Tribal Court Protective/Restraining Order (CLETS) to the cort together with a certified copy of your order.
- Restraining orders get entered into a special computer system at the California Department of Justice. This allows police officers across the state can find out about your order. Some counties will do this for you.
- To be sure, ask if the court will send your order to the state computer for you, If not, take a copy of the order to your local police.
Just as out-off-state orders are valid in California, if a restraining order is granted in a California court, but the person who is restrained moves to another state, the court order remains valid unless it is terminated by the court.
Another important thing to keep in mind is that violating a restraining order in another state can have serious consequences, as traveling across state lines with the intent of violating a restraining order constitutes a federal crime.
